Respected Sir,

 

The victim Ms. Rehena Bibi from District-North 24 Parganas, West Bengal came under the wrath of the perpetrators police personnel of Baduria Police Station. The perpetrator police personnel of Baduria Station refused to register her complaint in spite of the fact that the allegations made in the complaint made out cognizable offences, the police deliberately did not took any action on her grievances. Not only that the police reportedly called her at police station and demanded bribe from her and threatened her to rope her into false and fabricated criminal cases if the demand for money was not fulfilled. The victim was incapable to fulfill the demand for which the police already roped her and her family members in number of criminal cases. The victim and her family members became rubble in the hands of the perpetrator police personnel of Baduria Police Station. The victim lodged several complaints before the higher officials of police in the district against the perpetrator police personnel of Baduria Police Station but action was taken till date on her complaint. All such alleged illegal acts of the police are violation of the established laws and gross dereliction of duty which directly infringed the rights of the victim. Our attached fact finding report gives details of the incidents.   

 

We lodge this present complaint against the perpetrator police personnel of Baduria Police Station and also against the higher officials of the district who remained inactive on the complaint of the victim and seek your urgent intervention in this matter in the following manner:-

 

·         The whole matter must be investigated by one neutral investigating agency appointed by the Commission preferably not by any one from the district police administration.

·         The concerned police station must be directed to take immediate steps to register the complaint of the victim properly and take every legal action upon the complaint.

·         The complaints made by the victim against the perpetrator police personnel of Baduria Police Station must be taken due cognizance and the perpetrators must be booked under the law immediately and should be punished strictly under the law.

·         The victim and her family members must be relieved from all false and concocted criminal cases forthwith.

·         The victim and her family members must be immediately brought under due protection and they should be provided with proper compensation

Name of the victim: - Ms. Rehena Bibi, wife of Mr. Sirajul, aged about-37 years, by faith-Muslim, residing at village-Paschim Jaynagar, Police Station-Baduria, District-North 24 Parganas.

 

Name of the perpetrators: - The Officer-in-Charge and other involved police personnel of Baduria Police Station, District-North 24 Parganas

 

Case Detail:-

 

It is revealed during the fact finding that on 15.12.2011 the victim received information from one Mr. Bablu Misra, neighbour of the victim, that the police officer of Baduria Police Station namely Subirbabu asked the victim to meet with him at Katiahat Police Out-Post. The victim went to the said police out-post and met with the said police officer. The said police officer asked the victim whether she is Rehena Bibi. The victim told that she is Rehena Bibi. Then the said police officer told her that a case under section 326 of IPC has been started against her and she will be put behind the bar for at least three months. He also told that he can save her if she is ready to pay some money. The victim then asked him as to how much she has to pay. The said police officer told her to talk with his driver named Shibu. Then she talked with the said Shibu who told her that she has to pay Rs.10, 000/- otherwise nobody can save her and her husband from serving three months in jail. The victim told her incapacity to pay the money and returned home.

 

The victim on 16.12.2011 lodged written complaint in this matter before the Sub-Divisional Police Officer, Basirhat, North 24 Parganas requesting proper action against the corrupt police officials of Baduria Police Station for demanding money from her and threatening her to rope her and her husband in criminal cases. Since then the police personnel of Baduria Police Station came to the house of the victim for number of times with intention to apprehend them. The victim and her family members are staying out of the house out of fear of illegal arrest by police in false and concocted case and potential harassment.

 

The fact remains that the daughter of the victim namely Rupa Biswas was previously abducted by the elder brother-in-law of the victim namely Mr. Nazrul Biswas, son of late Nur Ali Biswas. Later the victim's said daughter was recovered and the involvement of Mr. Nazrul Biswas in her abduction also came to fore. In this connection Mr. Nazrul Biswas reportedly had grudge upon the victim and her family members. On 6.5.2011 at about 11 pm he and her family members criminally trespassed into the house of the victim armed with lathi, iron rods and brutally assaulted the victim, her daughter and son. The victim and her son sustained sever injuries and they had to be admitted in hospital for several days. The police of Baduria police station refused to take any complaint (First Information Report) from the victim against the assailants. The police only issued one GDE no. 300 dated 7.5.2011upon recording the incident in the General Diary Entry Book. Over such inaction of the police, the victim lodged one written complaint on 7.5.2011 before the Sub-Divisional Police Officer, Basirhat, North 24 Parganas requesting proper action against the corrupt police officials of Baduria Police Station and also requesting for initiation of legal action against the assailants under the law. But till date no action was taken against the assailants.

 

However the police roped the victim and her family members being her husband and son Sayan Biswas in connection with two criminal case vide Baduria Police Station Case no. 156/2011 dated 8.5.2011 under sections 341/325/34 of Indian Penal Code and Baduria Police Station Case no. 203/2011 dated 17.6.2011 under sections 324 / 325 / 326 / 307 / 506(2) /34 of Indian Penal Code. The said cases were initiated against the victim and her family members at the instance of the said Mr. Nazrul Biswas.

 

The victim stated before our fact finding that the police of Baduria Police Station are more prone in taking action on the complaint filed by Mr. Nazrul Biswas, on the other hand the police refused to take her complaint.
